This Privacy Policy (“Policy”) describes how RYZE10/X LLC, a Missouri limited liability company doing business as Ryze10/X (“Ryze10/X,” “we,” “us,” or “our”), collects, uses, shares, and protects your personal information when you access or use our platforms, products, and services (collectively, the “Services”).
By using the Services, you acknowledge that you have read and understood this Policy. If you do not agree with this Policy, do not use the Services.
1. Information We Collect
1.1 Information You Provide Directly. We collect information that you voluntarily submit to us, including:
(i) Account registration information (name, email address, password, location); (ii) profile information (professional background, skills, career interests, biography, profile photo); (iii) resumes, portfolios, and other career-related documents you upload; (iv) content you post in the Community, including comments, messages, and discussion contributions; (v) coaching intake forms and related materials; (vi) event registration information; (vii) payment and billing information (processed and stored by our payment processors, not stored directly by Ryze10/X); (viii) communications you send to us (support requests, feedback, inquiries); and (ix) affiliate program enrollment information.
1.2 Information Collected Automatically. When you access the Services, we automatically collect certain information, including:
(i) Device information (device type, operating system, browser type and version); (ii) IP address and approximate geographic location; (iii) usage data (pages viewed, features accessed, time spent, clickstream data); (iv) referring URLs and exit pages; and (v) cookies and similar tracking technologies as described in Section 6.
1.3 Information From Third-Party Platforms. We may receive information about you from third-party platforms integrated with the Services, including Circle (community activity and profile data), Stripe (transaction confirmations and payment status), and Netlify (site usage and performance data). We process this information in accordance with this Policy.
1.4 AI Tool Usage Data. When you use our AI-enabled tools, we collect the inputs you provide (prompts, questions, uploaded materials) and the AI-generated outputs. AI tools are powered by third-party services, including OpenAI. Your inputs may be transmitted to these third-party providers for processing, subject to their own privacy policies.
2. How We Use Your Information
We use the information we collect for the following purposes:
(i) To provide, operate, maintain, and improve the Services; (ii) to create and manage your account; (iii) to process payments and transactions; (iv) to display your candidate profile to recruiters who have purchased Recruiter Access, where you have made your profile available for this purpose; (v) to facilitate Community interactions and display your posts and contributions to other members; (vi) to deliver coaching services and related communications; (vii) to register you for and communicate about events; (viii) to administer the Affiliate Program and track referrals and commissions; (ix) to process AI tool inputs and deliver AI-generated outputs; (x) to send you transactional communications (account confirmations, billing notices, security alerts, support responses); (xi) to send you marketing and promotional communications, where you have consented to receive them; (xii) to analyze usage trends, monitor platform performance, and conduct analytics; (xiii) to detect, prevent, and address fraud, abuse, security incidents, and technical issues; (xiv) to enforce our Terms of Service and other agreements; and (xv) to comply with legal obligations.
3. How We Share Your Information
3.1 With Your Consent. We share your personal information with third parties when you have expressly consented to or directed the sharing. This includes making your resume or candidate profile visible to recruiters through the Career Platform.
3.2 Service Providers. We share information with third-party service providers who perform services on our behalf, including: (i) Payment processing: Stripe and other payment processors we make available; (ii) Community platform: Circle; (iii) Website hosting and AI features: Netlify; (iv) AI processing: OpenAI; (v) Analytics: Google Analytics; and (vi) Email communications: Google (Google Workspace / Gmail). These providers are authorized to use your information only as necessary to provide services to Ryze10/X and are contractually obligated to protect your data.
3.3 Legal Requirements. We may disclose your information if required to do so by law, regulation, legal process, or governmental request, or if we believe in good faith that disclosure is necessary to (i) protect the rights, property, or safety of Ryze10/X, our users, or the public; (ii) detect, prevent, or address fraud, security, or technical issues; or (iii) enforce our Terms of Service.
3.4 Business Transfers. In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you of any such transfer and any choices you may have regarding your information.
3.5 Aggregated and Anonymized Data. We may share aggregated or anonymized information that cannot reasonably be used to identify you, without restriction.
3.6 No Sale of Personal Information. Ryze10/X does not sell your personal information to third parties.
4. Data Retention
4.1 Active Accounts. We retain your personal information for as long as your account is active and as necessary to provide the Services.
4.2 After Account Deletion. When you request account deletion, we will delete or anonymize your personal information within thirty (30) days, except as set forth below.
4.3 Extended Retention. We may retain certain information beyond account deletion where necessary to (i) comply with legal, tax, or accounting obligations (including financial transaction records, which may be retained for up to seven (7) years); (ii) resolve disputes or enforce our agreements; (iii) prevent fraud or abuse; or (iv) fulfill any other legitimate business purpose permitted by law.
4.4 Community Content. User Content posted in the Community that has been viewed, shared, or responded to by other users may persist in anonymized form after account deletion where removal would disrupt the experience of other users.
5. Your Rights and Choices
5.1 All Users. Regardless of where you are located, you may: (i) access, update, or correct your account information through your account settings; (ii) delete your account by contacting us at john@ryze10x.com; (iii) opt out of marketing emails by clicking the “unsubscribe” link in any promotional email; and (iv) disable cookies through your browser settings (though this may affect functionality).
5.2 European Economic Area, United Kingdom, and Switzerland Residents (GDPR). If you reside in the EEA, UK, or Switzerland, you have additional rights under the General Data Protection Regulation, including the right to: (i) access the personal data we hold about you; (ii) request correction of inaccurate data; (iii) request deletion of your data (“right to be forgotten”); (iv) restrict or object to certain processing of your data; (v) receive your data in a portable, machine-readable format (data portability); and (vi) withdraw consent at any time where processing is based on consent, without affecting the lawfulness of prior processing. If you are not satisfied with our response, you have the right to lodge a complaint with your local data protection authority.
5.3 Legal Basis for Processing (GDPR). Where GDPR applies, we process your personal data on the following legal bases: (i) Contract: processing necessary to perform our contract with you (providing the Services, managing your account, processing payments); (ii) Consent: processing based on your freely given consent (marketing emails, sharing your resume with recruiters, cookie consent); (iii) Legitimate interests: processing necessary for our legitimate business interests (analytics, fraud prevention, platform improvement), provided those interests are not overridden by your rights; and (iv) Legal obligation: processing necessary to comply with applicable law.
5.4 California Residents. If you reside in California, you may have additional rights under the California Consumer Privacy Act (“CCPA”) and the California Privacy Rights Act (“CPRA”), including the right to know what personal information we collect and how it is used, the right to request deletion, and the right to opt out of the sale of personal information. 6. Cookies and Tracking Technologies
6.1 What We Use. The Services use cookies and similar tracking technologies set by third-party platforms integrated into our sites, including: (i) Circle: session and authentication cookies necessary for Community functionality; (ii) Netlify: performance and functional cookies for site hosting; and (iii) Google Analytics: analytics cookies that collect anonymized usage data to help us understand how users interact with the Services.
6.2 Purpose. These cookies are used for (i) essential site functionality and authentication; (ii) performance monitoring; and (iii) analytics and usage tracking.
6.3 Your Choices. You can manage cookie preferences through your browser settings. Most browsers allow you to refuse cookies, delete existing cookies, or alert you when a cookie is being set. Disabling cookies may affect the functionality of certain parts of the Services.
6.4 EU Cookie Consent. If you access the Services from the European Economic Area or United Kingdom, we will present a cookie consent banner before setting any non-essential cookies. Non-essential cookies (including Google Analytics cookies) will not be placed on your device until you provide consent.
7. International Data Transfers
7.1 Processing Location. Ryze10/X is based in the United States. Your personal information is transferred to, stored, and processed in the United States, regardless of your country of residence.
7.2 EEA/UK Transfers. If you are located in the EEA, UK, or Switzerland, your data is transferred to the United States, which may not provide the same level of data protection as your home jurisdiction. By using the Services, you acknowledge and consent to this transfer. Where required by applicable law, we rely on appropriate safeguards for international transfers, including standard contractual clauses approved by the European Commission.
8. Data Security
We implement commercially reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, disclosure, alteration, and destruction. These measures include encryption of data in transit, access controls, and regular security assessments. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.
9. Children’s Privacy
The Services are not directed to individuals under the age of eighteen (18). We do not knowingly collect personal information from anyone under 18. If we become aware that we have collected personal information from a person under 18, we will take prompt steps to delete that information. 10. Third-Party Links and Services
The Services may contain links to third-party websites, platforms, or services that are not operated by Ryze10/X. This Policy does not apply to those third-party services. We encourage you to review the privacy policies of any third-party service you access through the Services.
11. Changes to This Policy
We may update this Policy from time to time by posting the revised version on our platform and updating the “Effective Date” above. If we make material changes, we will notify you by email or in-platform notice at least fifteen (15) days before the changes take effect. Your continued use of the Services after the effective date constitutes your acceptance of the updated Policy.
